Cancellation & Refund Policy

1. Introduction
CTS-Simmonds Legal Chambers (“the Firm”, “we”, “our”, or “us”) is committed to providing transparent, fair, and professional legal services. This Cancellation and Refund Policy outlines the terms governing cancellations, rescheduling, and refunds for consultations and legal service engagements.
This policy is governed by the laws of St. Christopher (St. Kitts) and Nevis.
2. Consultation Appointments
2.1 Booking of Consultations
Consultations are scheduled upon payment of the applicable consultation fee through our online or direct payment system.
2.2 Cancellation by Client
Clients may cancel or reschedule a consultation by providing at least 24 hours’ prior notice.
- Where sufficient notice is given:
- The consultation may be rescheduled without penalty, or
- A refund may be issued, subject to administrative or transaction fees.
2.3 Late Cancellation or No-Show
- Cancellations made less than 24 hours before the scheduled consultation, or
- Failure to attend the scheduled consultation
will result in the consultation fee being non-refundable.
3. Legal Services & Retainer Fees
3.1 Engagement of Services
Upon engaging the Firm for legal services, clients may be required to pay:
- A retainer fee, or
- Advance payment for specific legal work
3.2 Earned Fees
Legal fees are earned progressively as work is performed.
Accordingly:
- Fees for work already completed or in progress are non-refundable
- This includes legal advice, document drafting, filings, research, consultations, and representation
3.3 Unused Retainer Balance
Where applicable:
- Any unused portion of a retainer may be refunded
- Subject to deduction of fees for work already performed and administrative costs
4. Fixed-Fee Services
For services provided on a fixed-fee basis:
- If work has not commenced, a refund may be issued (less administrative fees)
- If work has partially commenced, a pro-rata refund may be granted
- If work has been substantially completed, no refund will be issued
5. Disbursements & Third-Party Costs
Clients remain responsible for all third-party expenses incurred on their behalf, including but not limited to:
- Government filing fees
- Court fees
- Registration charges
- Courier or processing costs
- External professional or agency fees
These costs are strictly non-refundable.
6. Payment Processing & Fees
- Payments made via online gateways (including card payments or PayPal) may be subject to processing fees
- Any applicable bank, currency conversion, or transaction charges may be deducted from refunds
7. Refund Processing Timeline
- Approved refunds will be processed within 7–14 business days
- Refunds will be issued via the original payment method, unless otherwise agreed
8. Cancellation by the Firm
The Firm reserves the right to cancel or reschedule services due to:
- Unforeseen circumstances
- Conflicts of interest
- Regulatory or ethical obligations
In such cases:
- Clients will be offered a rescheduled appointment, or
- A full refund, where applicable
9. Exceptional Circumstances
Refunds outside this policy may be considered at the Firm’s sole discretion in cases such as:
- Medical emergencies
- Serious unforeseen events
- Documented exceptional circumstances
10. Limitation of Refund Rights
Clients acknowledge that:
- Legal services are professional services, not goods
- Outcomes cannot be guaranteed
- Fees reflect time, expertise, and professional judgment
Therefore, dissatisfaction with outcomes alone does not entitle a client to a refund.
